Mediation

Over the past decade, mediation has become a popular way for parties to reach a fair compromise. The reason that mediation is so popular is that it works. Plus, it is normally much less expensive than having a full blown trial.

Mediation is simply a process when an independent third party acts as a facilitator to encourage the parties to settle. The mediator, the independent third party, cannot order either side to settle. The mediator's role is to show each party their strengths and weaknesses so they understand the risk and expense of going to trial.

Attorneys Marty McDonald and Chuck Taylor are both Tennessee Supreme Court Rule 31 Listed Mediators. Mr. McDonald has participated in numerous mediations as a party's attorney or as a mediator in personal injury cases and domestic relations cases. Mr. Taylor has had the opportunity to participate in dozens of mediations as a party's attorney or as a mediator in cases involving personal injury or construction litigation. His experience in handling all kinds of complicated construction litigation is a huge asset in acting as a mediator in such cases.
